93 Plus Potential Land Disclosure Issues

93 Plus Potential Land Disclosure Issues 

 

Anyone involved in a typical Land transaction, leasing, buying or selling may be exposed to 93 plus potential Land issues. For years now I have advocated for need of a “Land Disclosure” form throughout our country. So far only four states have such a document available for the real estate industry and they are Arizona, California, Georgia and Tennessee.

 

Most states have “Residential Property Disclosure” forms which are executed at time of the listing by the sellers and reviewed and signed off by the buyers during the offering process. We recommend these forms to also be used even in cases where you are selling without the assistance of a real estate firm.

 

North Carolina’s “Residential Property Disclosure” form has only twenty-one issues, far less than the Land form who should have and fewer than other comparable forms found around the country.

 

Here are a few examples of the ninety-three plus potential Land Disclosure issues currently in place by the four states previously mentioned.

 

“Are you aware of any?”

 

Encroachments

Easements

Endangered species:  Plant   Animal

Flooding whether currently or previously

Forfeiture of rights (mineral, timber, development, etc.)

Government sponsored clean-up of the property

Goundwater contamination

Illegal uses (manufacture of liquor, methamphetamine, marijuana cultivation, etc.)

Landfill operations:  legal or illegal or previous planned

Mineshafts or tunnels

Noxious fumes or odors

Pipelines (natural gas, petroleum, etc.)

Well water contamination:  current or previous

Conservation Easements

Stream Restorations

 

“Are there any Gravesites on the Property?

 

“Are there any animal cemeteries or animal burial sites?

 

“Are you aware of the presence of:”

 

Asbestos, Benzene, Fuel/chemical storage, Paint  (Lead based paint) (Other paint/solvents), Methane gas, Pesticides, Radioactive material, Radon gas, Underground storage tank(s), EPA Phase I, II or III studies.

 

“Are you aware of any past or present issues or problems with any of the following on the property?”

 

Soil settlement/expansion

Drainage/grade

Earth Movement

Erosion

Flooding

Fissures

Dampness/moisture other than around rivers, streams, lakes, etc.

Sliding

Wetlands or previous wetland areas

 

Do you have a survey? When was it done? Who did the survey? Do you have a copy? Has it been recorded?

 

Is or will it be subject to protective covenants, conditions or restrictions?

 

Is the legal owner(s) of the Property a foreign person or a non-resident alien pursuant to the Foreign Investment in Real Property Tax Act (FIRPTA)?

 

Is the Property located in an unincorporated area of the county?

 

Is the Property subject to extra territorial jurisdiction?

 

What is the current zoning of the Property?

 

Has the property been timbered in the past 25 years?

Harvest monitored by a Registered Forester?

Timber replanted after the harvest with (species)

 

Is the property in an Agricultural or Forest tax deferment program?

 

Coming soon “Carbon Credits” that will also need to be disclosed.

 

Land can have a lot of issues and knowing all the aspects involved is critical for all involved in any of these transactions.

 

The Real Estate Industry “Realtor®” program has an established “The Realtor® Code of Ethics” as a guideline for practicing real estate. This code has seventeen articles. Article 11 states:

 

“The services which Realtors® provide to their clients and customers shall conform to the standards of practice and competence which is reasonably expected in a specific real estate disciplines in which the engage; specifically, residential real estate brokerage, real estate syndication, real estate auction, and international real estate.” (Our Professional Standards Committee voted unanimously in Washington in May this year at the NAR Mid-Year Convention meeting to include the four letter word “Land” in Article 11 of the code. It was approved by the NAR Board of Directors in San Diego in November and adopted January, 2010).

 

 

“Realtors® shall not undertake to provide specialized professional services concerning a type of property or service that is outside their field of competence unless they engage the assistance of one who is competent on such types of property or service, or unless the facts are fully disclosed to the client.  Any persons engaged to provide such assistance shall be so identified to the client and their contribution to the assignment should be set forth.” (Amended 1/95)

Unfortunately when one goes to real estate school around the country and takes the 160 +/- hours of classroom instruction and testing, they are not taught about Land, Commercial real estate, Property Management, etc., only about residential property and real estate law. Do not assume that all real estate agents have the knowledge in the specific areas of brokerage.

 

If you are buying or selling Land or Farms or Ranches, make sure to find a member of the Realtors Land Institute to help you in this process. Specifically look for an Accredited Land Consultant, their Designation for those experts in Land who have worked hard to achieve it.

Consult with a Land attorney if you plan to create your own “Land Disclosure” form.  If you are a real estate agent, please check with your Broker-in Charge before creating or using even if your state has a standard required “Land Disclosure” form already approved. Can’t get the horse on the left lead?

I have been riding this horse for about a month now. I don’t get to ride her everyday. She’s a Paint who’s sire was an Appendix QH. She’s 12 years old and nobody has ever worked with her and trained her consistently. She’s going to be shown in 4-h this year and possibly at local hunter shows as well. She’s just started jumping and she hacks out and gallops well. Her one big problem is that she will not get on the left lead! It’s driving me crazy. When I try to canter her in a small circle she only trots really fast and when i try to canter her in a bigger circle, she counter canters, I have no idea how she keeps her balance. When I canter her in an arena or field, she counter canters as well. It’s pretty much impossible to get this horse on the left lead. She doesn’t do changes either. I’ve had this problem for probably the last two weeks. What can I do to make her pick up the left lead?

Does she ever use that lead when she’s turned out?

Try to pick up the lead at the corner of the arena, from the trot. If she doesn’t do it, correct her quickly. Say out loud “no, wrong”, and try again at the next corner.

I disagree with the person that said tip her nose out. In my experience you want to tip her nose INside.

Also, lift your outside rein just a touch, like less than an inch, that will keep her from leaning in.

And use a strong aid outside, a good solid thump of your heal, behind the girth, (says use this rear leg first and get to work!)

¿I can claim the owner did not disclose lead paint?

I can rent a house in the century. When I moved the owner I said there was lead paint. It also reached the city and passed inspection of operating a rental unit. Inspector of the city has come to make their inspection, which does not include lead paint. I later learned that the state performs the test and the city did not participate. I called the State and said the owner never recorded owned or have been tested. I can sue for negligence? especially because I have a toddler in the house?

Any home that is one hundred years has lead paint. Take this as a fact. The state regulates the disclosure of lead paint and possibly penalties for noncompliance. In turn the state agency owner deals with the application of lead paint disclosure. Search with the search bar at the website of the State. And you can sue your landlord. But you do not get nothing unless you can prove the damage. Please have your child tested. You will need to speak with an attorney before proceeding.

Can I break my lease if I was not informed of potential lead paint issues?

I live in California. We moved into our place on March 17, 2011. We have a 1 1/2 year old. Today, we received a certified letter from the landlord’s asking us to sign a lead-based paint disclosure and return… as well as a brochure from the EPA about the danger of lead. There was an option on my lease where lead paint could have been disclosed and was not. We are upset that we were not offered this information at the time of renting… we would have stayed at our previous residence had this issue been made aware to us. The safety of my family is important. What are our options?

We have to get that form lead or no lead, this does not mean there is any at all. Every single landlord in every single rental in CA will be giving you that form. It does not effect your lease.

Who gets the money from fines in the EPA?

I would like to filter the money for the mentally handicapped or someone made by lead.

federal fines and penalties arising from (federal) environmental damage are collected and paid to U.S. Treasury – Not the body (EPA) itself. The fines imposed by the state may be something else – under state law. These collected and paid to the Treasury or elsewhere. This is due to a federal law called various (ARM). (Some states have similar laws on their books.) Moreover, while I am not familiar with the reduction of lead violations, other violations of environmental laws and regulations to carry a $ 37.500 (the $ 32 500 could be a couple of years ago) fine for each violation – and this may be, I think, $ 37 500 per violation per day, not just a matter of time. If someone does not and clean up the mess resolved quickly, the fines can add up quickly.

Learn To Paint Landscapes: 8 Basic Planning Tips

To learn to paint landscapes is to learn to be effective at planning. The idea is to make all the critical decisions about perspective, composition and even what supplies and tools to pack well before you even think about adding paint to the canvas.

It is an absolute myth that all great painters are just free spirits that only act spontaneously when the mood strikes. Consistently productive professional artists always refine their preparation routines in a way that positively impacts the final results of a painting. Here are 8 tips for successful landscape painting preparation.

1. First, take a walk around the landscape you wish to paint. It can be amazing how a slightly different perspective will reveal one of nature’s compositions that will just knock your socks off. Consider taking a sketch pad or even a digital camera to record your ideas as you walk about.

2. Select the time of day that the painting itself will take place. Picking the ideal time of day may mean investing an entire day starting at sun up and ending at sundown. Again, take photographs every few hours for later comparison. This may seem like a lot of unnecessary trouble but you may be surprised by the unique emotional impact found in the different periods of the day.

3. Decide the season to be represented in the painting.

4. Find a strong center of focus. This is usually an object that compositionally is so strong it demands your attention. All other objects in the painting should lead your eye to this object of focus.

5. Make test sketches before you begin painting. It can be amazing how interesting ideas will flow as you sketch. These same ideas would not necessarily present themselves by just looking at the scene passively. Some artists actually like to sketch the potential subject on the day before painting in order to solidify the composition. This allows them to focus mostly on the color aspect of painting. It is important to use the painting time wisely especially since the sun moves rapidly through out the day which constantly changes the emotional mood of the landscape.

6. Pack tools and supplies wisely. This is another activity that would be wise to do in a leisurely way the day before painting. It would be a shame to ruin the painting by forgetting some critical brush or paint color. Also make sure you include some food ,a first aid kit and some light rain gear. Over time develop a tried and true check list to make this effortless.

7. Consider returning to the same scene several times to paint at different times of day or different seasons to create a series of the same landscape. The continuity of this exercise can be a powerful educational experience.

8. Develop lots of basic landscape painting tricks and skills. Some of these might include learning to paint clouds, water drops, waves and surf, trees, flowers, gardens, lawns, rivers and roads just to name a few. One way to accomplish this is to acquire some of the many excellent painting tutorials available on dvd in stores or conveniently on the internet.

The bottom line is that speed is critical for creating art out of doors. Good attention to planning, organization and developing specific relevant skills will always produce positive results for those that wish to learn to paint landscapes.

The desire to reward green projects implies a need to track them. And that has led to the creation of new monitoring and counting systems in the form of certifications and accreditations. Armed with those forms of recognition, government agencies as well as private stakeholders are then able to offer rewards and incentives both for projects that involve public funding and for private projects that may be subject to local permitting, compliance or other regulatory or community oversight. The most robust and rapidly growing program that captures at least some significant portion of green building activity is the LEED certification program administered by the United States Green Building Council (USGBC).

The LEED certification program has grown very quickly since its inception in 2000. Accounting for approximately 30% of all green building projects – and growing at approximately 30% annually – government agencies have been major buyers of green buildings and associated materials. Government agencies tend to mandate green building standards for themselves and for projects they fund before they mandate (if ever) green building standards or incentives for any private entities they may have regulatory influence over. Although government’s share of total green building projects will eventually decline over time as non-governmental owners pick up steam, government projects will continue to help drive the industry as more and more agencies establish programs and mandates to meet green building goals. Also driving the government green building market will be the obsolescence and reconstruction of government buildings, many of which are approaching the end of their lifecycles.

Twelve federal agencies have adopted internal programs or policies that promote green building practices under the LEED system. These programs will surely grow and expand to other agencies in the future. As a tax, license, permit and fee-collecting entity, the federal government is also in an excellent position to create incentives for private sector green building – via LEED or any other program. Although the USGBC’s LEED program was originally catalyzed in part by a federal grant, there are currently no federal-level programs intended to encourage LEED adherence. Twenty one states have programs in place that require LEED participation for state agencies or state-funded construction. In addition, Maryland, Nevada, New York and Oregon offer incentives (tax reductions) for LEED projects and/or buildings.

Business demand is derived demand which ultimately derives from the demand for consumer goods. The businesses in the auto industry and similar fields are often dependent on one another. Business-to-business marketers transact for supply of raw materials to satisfy consumer market. An auto industry affects the following industry in different ways:

 

(a)   Steel industry – steel is a primary raw material used by car manufacturers. The auto industry is very much dependent on the supply provided by the steel industry. Operations cannot be processed without the materials. An increase in demand for cars also tends to increase of demand for the partner industry.

 

(b)    CD players – CD players are installed on manufactured cars. The auto industry partners with this industry to install CD players that best suits the different model of cars. This industry that supply CD players can also come up with speakers and other customize packages that best ensemble different auto models. The CD player industry can promote their products to final consumers to increase the business demand which will benefit both industries.

 

(c)     Safety airbags – the US government requires the installation of safety airbags to the auto industry. All auto industry is in a need for the supply of airbags.             There are three major types of buying situations. The straight rebuy, modified rebuy and new task. Each of which is applied in the following situations:

 

(a)   The Chrysler’s purchase of computers that is to be installed for the car’s performance is classified as a modified rebuy situation. In this condition Chrysler purchase involves high cost and risk and more efforts to evaluate, modify and gather specifications about the preferred product. Chrysler is more inclined to have a larger number of participants to make the decision purchase. They must assess cautiously all suppliers, prices, delivery, service terms and payment terms. They must also be rational in evaluating such purchase.

The existing or “in” suppliers must be careful to maintain and bring the best product to protect their account on Chrysler. They must be responsive and adapt with the changing existing market offerings because “out” suppliers find modified rebuy situation as an opportunity to provide products and better offering than what is offered by the existing suppliers.

 

(b)   The Volkswagen’s purchase of sparkplugs for its minivans is considered a straight rebuy situation. In this buying situation Volkswagen routinely reorders sparkplugs without necessary modifications. The regular operation of Volkswagen in car manufacturing necessitates its need for a continuous supply of sparkplugs from its suppliers.

The “in” suppliers in the straight rebuy situation may propose an automatic reordering system for the convenience of Volkswagen. They may also watch the inventory supply to respond quickly for the smooth running operations of Volkswagen. Moreover, “out” suppliers may add value and exploit dissatisfaction for them to be considered.

 

(c)    The Honda’s purchase for light bulbs for a new Acura model is considered a new-task situation. Since Honda is manufacturing a new-line car, new kinds and models of parts are needed. These parts include the light bulbs which will be all bought for the first time. In this situation the Honda’s rationality is put to test. Detailed product specification is needed to be evaluated carefully. Collection of information and large number of decision participants are very much needed in this situation. Prices, terms, services and various supplier offerings must be considered.

Marketers have the greatest opportunity in this situation. They must provide their product information and offer necessary help and assistance for them to influence buying decision participants.


 

 

  1. 3.      Using your university or college as an example, illustrate how the concept of systems buying might work if the university or college decided to purchase a new master computer system that would integrate all administrative, faculty and student information requirements into a single system. The system could be accessed by users on or off campus. What would be the component parts of such a system? How would you go about selling such a system to the university or college?

 

Purchasing a new master system that integrates information in a university should be a careful and rational activity. This concerns acquisition of a large, expensive and centralized capital item. The purchase of a new computer system demands a functionality that will best satisfy the challenging performance expected by the whole university. This deals with a large purchase decision participants that shall assess all pros and cons of various offered products. This computer system involves separate component parts such as computer units, large databases, expanded computer capacity, programs, applications and new operating system. Also services that are directly attributable to the purchase shall be considered, such as installation, training guides, regular maintenance, warranty, delivery and credit terms. The business buyer prefers to purchase the computer system from a single seller. The supplier must be able to provide a packaged solution to the problem and offer all component parts and the related services in one package. The supplier must be able to provide the most complete system package for them to win the account of the university and outdo other competitors.

The key marketing strategy of providing a packed solution to a problem from a single seller is called Systems Selling. Sellers must adapt systems selling as marketing tool; moreover, the seller must be capable to provide the group of interlocking products and some additional services such as system of production, inventory control and distribution that shall help in the smooth operation of the system.


 

  1. 4.      Assume you are selling cars to a company for use as fleet cars by the company’s sales force. The sales people would like bigger, more comfortable cars, which would be more profitable to you. However the company’s fleet buyer prefers smaller, more economical cars. Who might be in the buyer’s centre for this purchase? How could you meet the varying needs for these participants?

In this situation the business marketers must identify the buying center and the different influences on the business buyers. Profitability in the seller’s part is important but marketers must also put their considerations on the buyer’s needs. They must find ways on how they can best serve the business buyers. They must be aware of the participants in the business buying process. In this condition all participants influences the buying the decision but the USERS are the ones that very much convince the purchase in this situation. They are the members of the buying organization who will actually use the purchased product. Of course, marketers must respond to their preferences.

Other participants also have their relative influences. They have different evaluation criteria. For example, the INFLUENCERS provide the various product specification needed and to evaluate the alternative offers of different organizations. They are usually the technical personnel who guarantee that the needs of the organization are met. Also, the BUYERS, who have the formal authority to choose the supplier and negotiate the terms of purchase, must be taken into consideration. They are ones that weigh the cost and the benefits they can acquire from the purchase. The DECIDERS, who have the formal or informal power to select or approve the final suppliers, determine the advantages and values that each supplier can provide and the GATEKEEPERS, who control the flow of information to others, keeps the confidentiality of the purchase decisions and the important participants to prevent biased influences.

The purchase of fleet cars involves high cost transaction, thus necessitating more participants for a more rational decision. The personal and economic factors also influence business buyers. Marketers must continue to serve and concentrate on provide strong economic benefits to buyers. They must try their best to offer the lowest possible price for the best product. Also, they have personal preferences, characteristics, personalities and attitudes. They react to both reason and emotion.

Understanding all these concepts presents a challenge to all suppliers and marketers. The complex interactions and the ever-changing buying center participants are the forceful setbacks encountered by marketers.


 

 

  1. 5.      More and more business buyers are now purchasing products and services electronically, either through electronic data interchange (EDI) links or in the Internet. What are the benefits of such “cyber purchasing”? What are the negatives? What is the future of this growing field of commerce? Illustrate your view with an example.

Internet purchasing, also known as E-Procurement, has grown rapidly with the advances in the information technology. A lot of companies has already put up their company buying sites with convenient, well-designed and user friendly Web sites. Such cyber purchasing possess a package of benefits such as easy access to suppliers, low purchasing cost, it hastens order processing and delivery, more convenient purchasing, eliminates paper works and it is more time efficient and saving. Business to business marketers can also design a web site that also serve as an advertisement that is customized to meet various buyer’s needs moreover, marketers can focus more time on value added activities since it doesn’t have to constantly spend time and money to advertising, order processing and delivery. These businesses can also extend their customer services more efficiently through easy access detailed technical information, live chats with online representatives, customer suggestions and real time customer support. All of these can be performed in one internet program.

Although there are numerous benefits, there are also negatives on such cyber purchasing. It can erode decades-old customer-supplier relationships because it provides an easy Web search for other suppliers. Buyers are not contented to tie up with one supplier, they tend to frequently search for more benefit provided by other suppliers. Cyber purchasing can also create potential security disasters. This is the foremost problem of the businesses engaged in cyber purchasing, as we can see on the news, companies are having problems with hackers. These unauthorized personnel can access their main program and vandalize their sites, thus, companies are spending millions to maintain defensive strategies against these hackers. Also, secure business environment to carry out confidential transactions are lacking.

In my perception this “cyber purchasing” will continue grow with the developing markets since this easy to access business opportunity provides benefits for both buyers and suppliers. Unlike before when I bought my first PC, reaching customer support for technical problems are difficult to get in touch with. But nowadays there is much development. Recently when I bought my laptop, I first searched for the specifications and features that the product offers and now even minor problems encountered can be assisted easily through available information from the internet.

 

QUESTIONS RELATED TO PRODUCTS:

  1. 1.      Because the various classes of consumer products differ in the ways the consumers buy them, they also differ in how they are marketed.

(a)   Select what might typically be considered an unsought product and suggest how a marketer might convert this product into a specialty, shopping or convenience product.

(b)   Explain how some personal computer manufacturers have been able to convert their specialty products into broader-based shopping products.

Consumer products are classified differently, these differ in the way consumers buy them and how they are marketed. Consumer products include convenience product, shopping product, specialty product and unsought product.

(a)   Unsought products are products that either the consumer does not know about or knows about but does not normally think of buying. An example of this is life insurance. Life insurance companies are quite multiplying but some consumers do not know about what this service provides. Some doesn’t even think of purchasing and doesn’t consider it as a necessity. Companies must apply various strategies and a lot of advertising, personal selling, and other marketing efforts. They must fully aware consumers about their innovations. They must also introduce their products that will persuade consumers in the need of buying it. Marketers must present full marketing effort to show consumers the advantages in investing in the life insurance, thus making buyers necessitate the need of purchasing it, making it a specialty, shopping or a convenience product.

 

(b)   Specialty products are products with strong characteristics or brand identification for which a significant group of buyers are willing to make a special purchase effort. These are the luxury products in which there are little comparisons among brands. Apple Mackintosh is a computer manufacturer that is considered to be offering a specialty product before but nowadays it is considered as a shopping product manufacturer. Shopping products are products that the consumer, in the process of selection and purchase, characteristically compares carefully. Apple Mackintosh which is known to provide high quality expensive computers has shifted to be a shopping product organization for the reason that they are trying to broaden their market, not only to the upper class sector. They are trying to respond to the growing competition and the low price offering of other competitors. By offering products with decreased cost, consumers now consider Mackintosh as a variety for comparison for selecting computers. Consumers now carefully compare the suitability, quality, price and style with the competing brands.


 

  1. 2.      People can be thought of “products”.

(a)   Using the national election of 2010, indicate how the leading presidential candidate marketed themselves to the public. Think carefully of the tactics used, the advertising themes presented the image that was transmitted.

(b)   Construct a marketing profile of each of the major candidates.

(c)    From this analysis, what can you conclude about person marketing?

People can be thought of as products. This concept is known as person marketing which consist of activities undertaken to create, maintain, or change the attitudes and behaviour or target consumers toward particular people.

(a)   For the recent Philippine national election much person marketing has been done. Presidential candidates have used different strategies and techniques to be easily recognized and remembered. They have made their own slogans, logos, soundtracks, flyers, posters and other paraphernalia that would surely make trademarks for their presidency. This is the highest investment paid by these candidates. They try their best on how to uniquely appear to the public. They also used well-known personalities to help influence voters. For Noynoy Aquino, he released various commercials with different famous and influential personalities. He’s well known for the color yellow which was bought up also by Cory Aquino. His parent’s contribution also had helped him make a mark on the minds of the voters.

 

(b)   Noynoy Aquino is known for the different advertisements of Kris Aquino and other popular ABS-CBN personalities. His team created an advertisement of celebrities that tells the people of his responsible outlook as well what his parents has contributed. This strategy made him win majority of the votes. Manny Villar has made the color orange his trademark. He has the most investment in the advertisement among all candidates. Commercials of him with known personalities are always shown on TV. His ability to reach out to the poor are always emphasized. Joseph Estrada has still able to get the hold of the vote of the masses. Being the experienced former president and all the projects he has done are the watchword in his advertisements.

 

(c)    Person Marketing is all about building reputation of the company from different personalities. When this strategy is used skilfully, a person’s name can be a powerful brand. Influence to the consumers can be achieved.

 

 

 

  1. 3.      Brand name and symbol licensing has become a multi-billion dollar worldwide business. Using the information from the chapter and marketing highlight 82; devise a plan for licensing your school’s logo, mascot and other brand symbols. Your objective is to create toys, sportswear, gifts and logo items that will have national appeal. Could co-branding also be an option? Explain.

Building a strong brand involves a process that also presents marketing challenges. The major brand strategy decisions consist of brand positioning, brand name selection, brand sponsorship and brand development. A brand is a name, term, sign, symbol or design or a combination of these that identifies the products or services of one seller or group of sellers and differentiates them from those of competitors. Many companies and institutions spend much to build strong brands. Building strong brand for University of the East, it must try its best to outshine other universities. By offering exclusive products, they can apply this brand strategy.

Creating these customized toys, sportswear, gifts and logo items must be well differentiated to the other universities. Having this product must create a prestige on the minds of the students and shall influence others on buying such or even being part of the school’s community. UE must use their logo, mascot, and other brand symbol to be placed to its products. For example, students can purchase different UE customized items in the souvenir shop like mugs, shirts, lanyards, slippers, umbrella, pens, toys, etc. We can notice the logo of UE imprinted on the items. They continuously create new designs and items. The warrior logo is often times also used in such items. Majority of the products available for sale are in color red.

In my opinion co-branding can be an effective strategy. Co-branding is the practice of using the established brand names of two different companies on the same product. The sportswear offered can be a brand of Speedo or Nike. These brands are usually sponsors of the school which help each other market its products.  The shirts and jackets available for sale are created by popular clothing manufacturers with an imprinted UE design. Co-branding offers many advantages because each brand dominates in different categories. There must be a coordinated relationship between the other brands because this involves complex legal contracts and licences. Limitations must also be observed, because a negative image of one brand can affect drastically the other.

 

 

  1. 4.      Assume that you are hired by General Motors to develop the alternative product concepts for a voice-activated, verbal internet link, it plans to make available in its luxury cars. This system would allow automobile’s occupants to access the Internet, e-mail and e-shopping sites while driving or riding around. In developing the three concepts, think carefully about who could use such a system, and when, where and how. Which of your three major concepts do you think has the greatest potential?

A new alternative product concept is a detailed version of the new product idea stated in meaningful customer terms. General Motors must develop an attractive idea that can be developed to the new product concept. General Motors must begin to commercialize its experimental computer-powered luxury cars. The efficiency of their system must be well communicated. Its advantages and suitability must be emphasized. Our task is to develop this product into a new alternative product concept, evaluate each concept and identify the most attractive one. We may create the following concepts:

Concept 1 – A luxury car with an ideal high-technology system with provides an easy access to the internet while on the road.

Concept 2 – A car suitable for working individuals who can receive quick information and transactions while driving.

Concept 3 – A car with an installed computer information system designed with a voice-activated feature for the safety and convenience of drivers.

Concept number 3 has the most potential. It explained well its functionality in a short statement. The concepts developed must undergo concept testing with a group of targer consumers to find out if the concepts have strong customer appeal. They must present a concrete and physical presentation of the concept to increase reliability of the concept testing. Before attempting to release a concept it must pass through a critical testing to assure the acceptance of the product to the public. Product’s ability to sell, even though it can provide a bundle of advantages and efficiency, may not be very appealing to target consumers because of its poor product concept.

 

 

 

  1. 5.      Pick a soft drink, car, fashion, food product or electronic appliance and trace the product’s life cycle. Explain how you separated the stages of the product evolution. Project where this life cycle will go from here. Which product life cycle stage, if any, is the most important? Which is the riskiest? Which stage appears to hold the greatest profit potential? Which stage needs the greatest of “hands-on” management? Be certain to explain the thinking behind each of your answers.

 

New-product development is the development of original products, product improvements, product modifications and new brands through the firm’s own research and development efforts. I will take Coca-Cola as an example; years ago they created a twist on the traditional Coke. They created flavours on the usual offering; they introduced the Coke cherry and vanilla. Before introducing this to the market the company must pass through the stages to new-product development. Introducing a new unusual product is very much risky and assurance of success cannot be determined. The company must develop a strong new product planning and undergo the systematic product development process.

The first stage is the IDEA GENERATION. This is the systematic search for new product ideas. Coca-Cola must consider both internal and external sources. Through the internal sources, the company can perform researches and brainstorming of qualified marketing individuals. They may also encourage employees to contribute their own ideas and perceptions.  Through the external sources, they can perform various surveys from the customers.

Second is the IDEA SCREENING. This stage is the evaluating of new-product idea to spot the good ones and drop the poor ones as soon as possible. The company must analyze all factors that will affect the new product development and determine its pros and cons.

Third is the CONCEPT DEVELOPMENT and TESTING. The company must present the idea in meaningful customer terms and further testing to assure the efficiency of the new product. This statement must be attractive to customers for it to be differentiated to other market offering. The idea of Coke in releasing its new flavours is very much new to consumers. It has a unique characteristic that can outshine others.

Forth is the MARKETING STRATEGY DEVELOPMENT. It is designing an initial marketing strategy for a new product based on the product concept.

Fifth is the BUSINESS ANALYSIS. This is the review of the sales, cost and profit projections for a new product to find out whether these factors satisfy the company’s objectives.

Sixth is the PRODUCT DEVELOPMENT. This is developing the product concept into a physical product in the order to ensure that the product idea can be turned into a workable product.

Seventh is the TEST MARKETING. This is the stage in which the product or marketing program are tested in more realistic marketing setting

Eighth and last step is COMMERCIALIZATION. This is introducing the new product to the market.

Though this product is well studied market demand and other uncontrollable factors contributed to the decline of the Coke cherry and vanilla.  This product has undergone all the product life-cycle stage. PRODUCT DEVELOPMENT where the Coca-Cola invested for the new product. It underwent the INTRODUCTION stage where the company encountered heavy expenses for the advertisements and commercialisations. The GROWTH stage, where the product’s sales started to climb quickly, is when customers are delighted in the new offering. The MATURITY STAGE, when the growth of sales levels off, is when such offering is turned down by consumers and the DECLINE stage, when the product sales decline. This product was permanently eliminated from the offering of Coca-Cola Philippines. This product is still available in other countries where it is very much accepted.

I have a cast iron pot holder from the 50s used to set hot pots on while cooking, is the paint on it leaded?

As the question itself informs, I have a cast iron pot holder, of the sort set on one’s stove top to place hot pans on while cooking. It has a few objects/people artsily designed into it which are painted various colors. The paint is in relatively poor condition, and flakes/peels.

Could the paint contain lead? Were all things from that era painted with lead paint? Is this a health hazard? Should I have it tested? How?

Brad, this is called a trivet, and yes it may very well be painted with lead based paint due to the age of the item. However, as it’s use is only intended to touch the outside bottom of a pot, the paint should be a non issue.

Burj Dubai Lake Fountain Program

An area of 20,000 square meters of the lake was previously used as a temporary lake to capture storm water runoff and had been subjected to bacterial growth. These areas were cleaned to remove bacterial growth and then treated with X-Treat Sanitizer to sanitize the surface of the concrete to prevent future bacterial growth. Surface preparation was completed using a captive blasting technique. Six captive blast teams were able to prepare 6000m2 of concrete surface per day. That process produced a lightly exposed aggregate finish that revealed all the bug holes (blow holes). X-Shield Bug Fill, a two component high-build thixotropic epoxy resin, was used to fill bug-holes and surface imperfections prior to coating the lake bed.

Only 4 years old and a central feature of the prestigious Westin Diplomat Hotel, the group of 3 fountains was discovered to be leaking water into the foyer and below ground parking area. The fountain constructed from concrete was originally coated with an epoxy coating which was showing signs of cracking and delamination. As these fountains were located in the central reception area of a very busy hotel any remedial work had to be carried out quickly with minimal disruption to guests. The need was for a lining system that would cure quickly allowing quick return to service, flexible UV and chemical resistant and could function under full immersion.

Rawmat HDB – Waterproofing Case History

The elevator pit needed to be deepened to satisfy building codes. The elevator shaft was also prone to frequent flooding due to the high water table. Geotechnical investigation identified Perchloroethlene (Perc) in the ground. Perc is extremely volatile and classified by the EPA as a Class1 carcinogen. Perc is a strong solvent and very aggressive to most waterproofing materials. The problem was finding a waterproofing system that would resist Perc. Under the direction of Environmental Consultant GZA, contaminated water was collected and used to test Rawmat HDB membrane to prove that the product would be resistant to the Perc contaminated into system.

Reflecting Pond, 3M World HQ

Originally built in the late 1960s, this Reflecting Pond was lined with asphalt and contained 3ft deep water. Due to the harsh Minnesota winters the pond only held water for 6 months of the year (May-Sept). Over time, the asphalt substrate had cracked and it was costing the owners $30,000 to $40,000 per year to keep the pond watertight. The need was for a lining system that could waterproof the aged and cracked substrate and also withstand the 6 months wet and 6 months dry UV exposure for many years with out cracking.

 

Renovation of Hotel Roof

The existing roofing system was a 16 year old 8000 ft2 EPDM fully adhered membrane roof. Constant maintenance and repairs had been completed over the life span of this system. Numerous leaks into the structure had frustrated the management and prime rental rooms were unable to earn revenue because of water damages, falling drywall and the odd odor of mildew. It was determined that bad flashing details, splitting seams and screws from the mechanical attachment of the 1″ ISO insulation were backing out and popping through the EPDM membrane

X-Shield FS450 – Big Springs Fish Hatchery

The existing concrete substrate was painted with a lead based paint that was flaking and delaminating. There were also traces of PCB contamination in the concrete. The fish hatchery was located up stream of a heavily fished spring which presented the danger of contamination to both fish and wild life in addition to local residents. There were also numerous cracks in the concrete. A total of 52,000 ft2 of concrete need to be coated. After the lead paint was safely removed the Engineer required a coating that would form a dense barrier to the contaminated concrete and also have the ability to accommodate the cracked concrete. A key factor was also that the coating had to be no toxic to fish and wildlife.

Due to the complexity of the cladding design many of the gutters were unsuitable for the specified Hypalon ® sheet membrane to be used as it requires to be cut, welded and glued. In addition the gutters had many penetrations. The cladding sub contractor required a fast cure liquid membrane as many other trades were on the roof and we jumping in and out of the gutter. This traffic would damage a conventional liquid membrane as it would need more than 24 hours to cure.

Airport Hanger Gutter Waterproofing

A concealed aluminum gutter system was used on these structures to channel away rain water. The joints were simple overlaps riveted together. Minor leakage through the joint was acceptable as rain in Dubai is infrequent and the gutters would drain the water away quickly. The problem was with dealing with the early morning condensation which created an unforeseen volume of water. The gutter design was not able drain away this amount of water quickly resulting in almost daily leakage of water through the joints.

New Environmental Protection Agency laws that went in to effect in April of 2010 require the use of HEPA vacuums during renovation, repair, and paint work on pre 1978 homes. The rules referred to as RRP affect contractors, property managers, and landlords. The role of the HEPA vacuum is to provide the primary means of cleaning up lead based paint dust and debris. Since clean up of lead is the primary objective, the HEPA vacuum is the single most important piece of equipment that a contractor and property manager can purchase. Purchasing the wrong lead paint vacuum that does not do the job properly will cost countless hours in re-cleaning job sites, and worst yet, leaving a contaminated job site. Improper cleaning can lead to fines of $37,500.

EPA Renovation, Repair, and Painting (RRP) Rule requires the use of equipment with a High Efficiency Particulate Air filter under two circumstances: “HEPA Vacuum” is required as part of the interior work area cleaning: 40 CFR 745.85(a)(5)(ii) states that “The firm must clean all objects and surfaces in the work area and within 2 feet of the work area in the following manner, cleaning from higher to lower: 1. Walls. Clean walls starting at the ceiling and working down to the floor by either vacuuming with a HEPA vacuum or wiping with a damp cloth. 2. Remaining surfaces. Thoroughly vacuum all remaining surfaces and objects in the work area, including furniture and fixtures, with a HEPA vacuum. The vacuum must be equipped with a beater bar when vacuuming carpets and rugs.” EPA defines a HEPA vacuum at 40 CFR 745.83. “HEPA vacuum means a vacuum cleaner which has been designed with a high-efficiency particulate air (HEPA) filter as the last filtration stage. A HEPA filter is a filter that is capable of capturing particles of 0.3 microns with 99.97% efficiency. The vacuum cleaner must be designed so that all the air drawn into the machine is expelled through the HEPA filter with none of the air leaking past it.”

The message is clear. Vacums for lead paint removal must be purpose designed from the beginning. Adding HEPA filters to vacuums that were not designed for the task will only compound problems. Purchasing the right vacuum is of paramount importance.

One of the major issues with HEPA vacuums is the rate at which filters clog. Since filters capture 99.7% of dust at.3 microns, the filters have a tough job to do. In performing their task, they choke up quickly with fine dust and debris, causing the vacuum to load up and reduce the airflow and cleaning power. This leads to big problems during lead clean up; the vacuum is not cleaning properly, and the operator is forced to change filters in the middle of the operation. This is a dangerous slope to go down, because changing filters in mid-job risks introduction of lead dust back in to the job site. Also, one of the major complaints from contractors is the frequency and cost of changing the HEPA filters. One contractor is spending upwards of $400 per month on replacement filters for just one machine.

The answer to the problem is using a lead paint removal vacuum that has self cleaning filter technology. RRP la règle de plomb et les entrepreneurs: la survie du plus fort!

Depuis Juin 23, 2008, sous l'autorité du contrôle des substances toxiques Loi (article 402 (C) (3) rénovateurs résidentiels et commerciaux sont tenus de distribuer un dépliant d'information risque de plomb pour les propriétaires et administrateurs d'immeubles occupés par des enfants avant début des rénovations en eux. Le PPC, qui se tient pour la rénovation, de réparation et peinture de la règle, s'applique aux bâtiments construits avant 1978 et son intention de réduire la quantité de poussière de peinture au plomb créé par les projets de rénovation qui perturbent le plus de six pieds carrés de surface pour la rénovation intérieure (deux pieds carrés en HUD) ou vingt pieds carrés si le travail se déroule dans l'extérieur.

L' nouvelle règle de l'EPA est devenue obligatoire enfin en Juin 2010. Depuis lors, les entrepreneurs doivent être certifiés par l'EPA et de suivre les pratiques de travail spécifiques pour prévenir la contamination, y compris le revêtement de sol en plastique bâches, dressing travailleurs des vêtements de protection, et soigneusement l'élimination des débris contaminés. Contractors Must Comply With EPA Lead Paint Regulations

Areas of the country with older homes will be in for rude awakening. Remodeling costs are likely to increase because of new EPA RRP lead paint regulations. All houses built before 1978 are under the new federal regulations.

Lead is a poison, and lead based paint was used extensively during pre 1978 construction. Doing renovation, repairs, or painting activities that disturbs existing lead paint areas , requires compliance with the new EPA RRP Lead Paint Rules & Regulations. Law requires contractors working on pre 1978 homes with lead to be EPA certified. The EPA designation is a “Lead Safe Certified Firm” or “Certified Renovator” . Heavy fines for violation of the federal EPA lead rules will hit contractors that don’t comply. Disturbing lead paint and not following the rules can result in $37,500 fines. Homeowners are wise to verify EPA Certification credentials before hiring a contractor for their own safety.

What does all this mean ? There are specific steps that must be followed in the complex maze of regulations in order to manage lead dust and debris during construction. Simple renovations like bathroom remodels , kitchen remodels , window replacement, dry rot repair, and additions will all be impacted by the new laws. The job for contractors will be harder, longer, and more expensive. Jobs will cost more from contractors due to added labor and material costs.

EPA regulations specify cleaning procedures, work site practices, and documentation requirements in order to be compliant with the new regulations (knows as RRP or Certified Renovator Firm ). Firms that have been through the training successfully typically display the green EPA “Lead Safe Certified Firm” logo.

One of the most important elements of job site clean-up is the use of HEPA lead paint vacuums. This is a specially designed vacuum for the collection of lead dust, using certified HEPA filters.

One of the major issues with HEPA vacuums is the rate at which filters clog. Since HEPA filters capture 99.7% of dust at .3 microns, the filters have a difficult job to do. Lower quality HEPA vacuums clog up frequently.
